POLICIES
Free Consultation and Estimate

Bam, Boom & Kewpow, Inc. does not bill potential clients for initial consultation
in which we discuss your needs.
We would be happy to provide a free quote, which is valid for thirty (30) days. After
30 days, all quotes will become null and void and a new quote must be requested.
Non-disclosure
- Bam, Boom & Kewpow, Inc. acknowledges and agrees that any and all source materials,
technical and/or marketing plans, or other sensitive business materials supplied by
to us by clients and potential clients in the course of developing the design or design strategy, are considered
confidential information and shall not be disclosed to any third party.
Work Process
- A deposit, as mutually agreed upon, is due before work commences. Once work has
commenced, said deposit is non-refundable, with exception of special
circumstances upon mutual agreement.
- If, at any time during the work process, you become unreachable for an extended
period of time, or fail to respond to email or phone communication for a period of 14
days or more, and do not notify Bam, Boom & Kewpow, Inc. in advance of your absence, your
project may be placed on hold.
In this event, when you do return, we will reschedule the time frame for completion
depending on any new work commenced during your absense. Good communication is vital,
and we are very flexible as long as good communication is maintained.
Site Access and Release of Website Development
- Clients must not access their web files during the development process as this can
result in errors or unintended file deletions and may involve repair fees. Once
development work has been completed and approved, and final payment has been received,
clients may access their site files as desired and at their discretion if they wish
to do so.
Acceptable Use Policies
- No persons may use Bam, Boom & Kewpow, Inc. facilities, services, products or
capabilities to conduct, or solicit the performance of, any illegal activity, or to conduct any
other activity which infringes on the rights of Bam, Boom & Kewpow, Inc. or any third party.
- No client may upload, submit for use in design or otherwise transmit any message,
data, image or program that would violate the property rights of any third party.
This includes the unauthorized transmission of copyrighted text, images, music,
programs, or trade secrets or other confidential proprietary information,
trademarks, service marks or trade names used in an infringing manner.
Customers may not upload or transmit any information which is libelous or
defamatory, or which violates or infringes on any right of privacy of any person.
Refusal of service
- Bam, Boom & Kewpow, Inc. reserves the right to refuse service to anyone at its
sole discretion.
Indemnification
Client agrees to defend, indemnify, save and hold Bam, Boom & Kewpow, Inc. harmless from any and
all demands, liabilities, losses, costs and claims, including reasonable attorneys
fees asserted against Bam, Boom & Kewpow, Inc., its agents, its customers, officers and employees
that may arise or result from any service provided or performed or agreed to be performed
or any product sold by the client, its agents, employees or assigns. Client agrees to
defend, indemnify and hold Bam, Boom & Kewpow, Inc. harmless against liabilities arising
out of; (1) any injury to person or property caused by any products sold or otherwise
distributed (2) any material supplied by customer infringing or allegedly infringing on
the proprietary rights of a third party; (3) copyright infringement.
(With humble apology to our lawyer, or any other... in plain English, this means that
if your product or service causes harm to any third party, we am not responsible because
we developed your website or marketing campaigns. If you send us information to post to
your website and it turns out to be a copyright infringement, we are not responsible, you are.)
